The steps towards legal justice for vaccine injured and bereaved.
A brief word on the CICP, VICP programs, and the PREP Act.
Late last year, I wrote an article on preparing for lawsuits for those who suffered vaccine injuries and who lost a loved one after Covid-19 vaccine injury.
Since then, I have worked with one of our country’s top vaccine injury attorneys— a professor who understands the vaccine injury laws well—. During some of our calls, we have had two physicians, two additional attorneys, and a former FDA senior advisor take part in these calls to discuss a route toward justice for the above.
With the help of the wisdom from these professionals, we have given information to the Florida Department of Law Enforcement Chief Counsel for the Covid-19 MRNA shots Grand Jury Investigation, and we have also presented information to the Congressional Oversight Committee for COVID-19, State Attorney Generals, and others.
Many others with similar concerns for justice for these groups are working with lawmakers and organizations on these matters. One pressing subject is the lack of compensation (overburdened, outdated, unreasonable and unresponsive CICP and VICP vaccine injury compensation programs), reasonable statutes of limitations, and access to court hearings for vaccine-injured and bereaved families. It has been said online and on social media that court cases can be filed against the vaccine manufacturers in the case of willful misconduct.
However, one of the critical points that I learned in working on these matters is that, sadly, even in the case of willful misconduct, a CICP/VICP case must be found favorable for the plaintiff, and even after this, the HHS secretary or the Attorney General has to initiate proceedings/enforcement actions against the manufacturer or distributor that result in penalties first before a case can be presented, as follows, "When the act or omission alleged to be willful misconduct is “subject to regulation” under the Public Health Service Act or the Federal Food, Drug, and Cosmetic Act (e.g., by FDA), an injured person cannot succeed on a willful misconduct claim unless the Secretary or the Attorney General has brought certain enforcement actions against the manufacturer or distributor that result in the imposition of particular penalties." This is why some are working towards constitutional challenges and why some representatives and lawmakers have proposed bills to repeal or revamp the above programs.
Please take the time to learn about the PREP Act, the VICP, and CICP programs. Most (who have not experienced injury or loss) do not know that if you or your child/loved one is injured by a vaccine, even if your (or your loved one’s) case meets the first set of challenges in the CICP, then, as seen above, “If they choose to file a lawsuit, injured persons may sue only in the U.S. District Court for the District of Columbia. Such lawsuits must meet heightened standards for pleading and discovery and are subject to procedural provisions generally favorable to defendants. Injured persons must prove willful misconduct by clear and convincing evidence (a higher standard than in a typical civil case), and recovery for noneconomic damages such as pain and suffering is limited.” [1.]

This is why many are asking for those who have a concern for future childhood vaccines, have lost a loved one, or are vaccine-injured to contact your local, state, and federal representative to make changes, get involved, and stand strong against censorship or lack of action from your representatives. They “Represent” you!

A final word: I urge you to have all of your hospital records, medical records, lab work, and documentation organized and with at least two copies kept in a safe place. Many people are working to help those who are injured and who have lost loved ones to obtain answers and to change the current programs and laws so that they are reasonable and just. It will likely be a long road, and these documents should be readied and put in order before copies are lost, etc. You may need them to show the representatives and organizations that will work with you to bring your information forward.

Your case is very moving. I am not affected by vaccine injury ... but I must add to that statement “... that I know of.” Covid and stories like yours have caused me to stop vaccinating my kids and myself. We will no longer participate in that barbaric practice of injecting vials of toxins into soft tissue until there are better studies available to show its ultimate impact to health.
As I reconsider the health of my own family, I wonder if our various allergies, asthma and my own fibromyalgia could be a result of the many vaccinations we have endured over the years. I no longer trust. I am, in fact, homeschooling my youngest child rather than subject him to the shots required for him to attend public school. I am serious when I say “NO MORE”
The injuries others have suffered from the various covid injections are staggering in severity and number, they dwarf the injuries endured from past vaccines, like an absolute tidal wave of pain and suffering. There are not enough laws and procedural harassments to protect the purveyors of this “technology”... though it may take many more years, there will be relief provided by the courts. Defendants may delay delay delay but ultimately there are too many plaintiffs. Once the first cases work their way through the body of the beast, there will be more and more until catastrophic failure of the machine that produces and pushes toxic medical products into innocent people. I wish strength and courage to those at the forefront of this fight!
